Restored KP properties in Kashmir: PNBMT
Jammu, May 25 (Scoop News)- Prem Nath Bhat (PNBMT) has been pursuing the cause of the protection and restitution of the KP properties in Kashmir for the last two decades. In a meeting of the technical committee attended by C.L.Pandita Acting Chairman,Advocate Kashmiri Lal, Virender Raina ,Chief Spokesperson,Shadi Lal Koul Rais, General Secretary.




Members expressed satisfaction that the efforts of the group in the recent past for Judicial and administrative action in matters of usurpation and unauthorised occupation of temple and shrine properties and also agrarian and other such properties have shown positive results. Judiciary and Qasi judiciary bodies have given pro active response. In a recent case land belonging to Shri Vinayak Prabandhak Committee at Wanpoh Distt. Kulgam, 10 kanals are under the occupation of a govt department. In a case before the honourable High Court, govt counsel has assured the verification of facts on the ground and restoration of status quo ante after ascertaining the facts on the ground. Similar actions to secure the Gopitirath Ishber Nishat has been ordered so as to prevent its reoccupation.


While addressing the meeting Adv.Kashmiri Lal said that In a case before Shaleen Kabra IAS, Financial Commissioner Revenue J &K/ Commissioner Agrarian Reforms, cases of various displaced Kashmiri Pandits parties having been divested of their agrarian lands in Kashmir after 1990. These displaced KPs were divested of their lands by way of farcical mutation in flagrat violation of instructions from time to time regarding attestation of mutation under section 121 of land revenue act and also in violation of J&K Migrat Immovable Property Act 1997 and Migrant Stay of Proceedings Act 1997 and most blatantly without the knowledge of the original owners of the said lands or petitioners.In view of these blatant violation of the process of mutation the revision petition was accepted and the wrong mutations of the estates of Watdora Galwanpora Budgam was set aside and the entries as existed before prior to the farcical mutation are restored.

Mutation no.1804/1809 of estate Arigam Budgam

Mutation no 2546 of estate B.K.Pora Budgam
Mutation no.1426/1431/1465/1845 of estate Ichkoot Budgam
Mutation no.3803 of estate Humhumama Budgam.
The reference in hand have been made to the court pursuant to section 15(3) of Land Revenue Act by the Additional Comissioner Kashmir( with powers of Divisional Comissioner) recommending therein to set aside various mutations attested under section 121 of the Land Revenue Act concerning Migrat Properties. Although the parties and the estates to which the cases pertain are different, but since the nature of the mutations and their attestation raise a range of issues that are similar, the references have been taken up together. The references have been made on different dates and at times several mutations have been dealt with in a single reference. The court has segregated the cases on the basis of mutations.
Virender Raina said that, It may be recalled that in past a high level delegation of PNBMT had met the Financial Commissioner Revenue and apprised him of about the farcical mutation of migrant KP lands in Kashmir and subsequently the actions followed. While the cases were argued by different counsels, a preliminary argument by all the counsels was that the sou moto revisional powers have statedly been invoked pursuant to the directions of the honourable High Court in All India Kashmiri Samaj V/S Union Of India & others. Incidentally Adv.Kashmiri Lal is also pleading that case also.
C.L.Pandita assured members that we will continue to act in a pro active manner and would act where ever any issue of usurpation or unauthorised occupation of temple or agrarian properties comes to our notice....
