NPP urges President to direct J&K LG to release all PSA detenues
and provide full internet facilities
Jammu, March 26 (Scoop News)-NPP Supremo, Prof. Bhim Singh has in a communication urged the President of India, Shri Ramnath Kovind to direct the Lt. Governor in J&K, Shri Girish Chandra Murmu to release all those political activists in J&K detained under Public Safety Act on or after 5th August, 2019 without any delay. He strongly argued that Public Safety Act is no more a valid law since its source Article 35A was quashed by the President on 5th August, 2019. He has already challenged the validity of Public Safety Act before the Supreme Court of India. The case was listed for hearing on 7th April, 2020 which may not be considered by the Supreme Court following the closure of the Courts because of the Corona Virus and Lockdown in the whole country for 21 days. Prof. Bhim Singh has also urged the Supreme Court to pay appropriate compensation to all the political and social activists who were unconstitutional, illegally and with malafide intention were locked in detention by Jammu & Kashmir administration inside and outside the State.
Prof. Bhim Singh also urged the President of India to direct the Lt. Governor of Jammu & Kashmir to restore all facilities guaranteed in the internet to the residents of Jammu & Kashmir at par with the Indian citizens in the rest of the country. He said that 2G does not provide full internet facilities and it amounts to discrimination under Article 21 of the Indian Constitution to the Indian citizens in J&K. He has raised this issue also in his writ petition filed in the Supreme Court.
Prof. Bhim Singh also urged the President to grant special leave from jails to those life prisoners who have completed more than 14 years in jails after life sentence was considered as sentence for the rest of life. This has been challenged before the Apex Court also. He said that International Law and concept of Fundamental Rights demand that the life imprisonment should not extend beyond 14 years spent in jails with remission. He argued that under the present situation and circumstances created by Nature, the Indian Laws need to be amended and liberalized to fit in the rule of law (not the law).
