| Apathy towards refugees-(IV) | |

It is settled phrase that “Justice delayed is justice denied”. If refugees from West Pakistan, PoK, War time refugees are not getting their dues since migration and many have left this world with the hope that political wisdom will prevail one day and they will get all rights, guaranteed under the constitution of India and that of the state. The long delay will change the phrase from justice delayed is justice denied to “justice delayed is justice dead”. Refugees are human being and if we cannot give equal treatment it will not only in justice to them but it will amount to utter failure of democracy. DP’s of Chhamb 1965 camp and non-camp wants grant of occupancy tenancy rights on EP land and further ALC certificate be granted to them, as they are settled near international border. Proper/adequate compensation be paid for their land, which came under border fencing. A package of cash compensation is required for 1965 displaced persons on analogy of camp DPs of 1971 and 1947 PoK DPs. Rather a new package after survey of minimum five lakh per family be made applicable to all types of refugees, it will be a honest step to implement the directions and observations made by Hon’ble Supreme Court and other courts . Chhamb Displaced of 1971 consist of camp DPs 1971 and non camp DPs 1971. Camp DPs of 1971 wants occupancy/tenancy rights under 3-A of Agrarian reforms Act 1976 be given and basties be separately taken up for development plan. Different schemes be initiated for absorbing them in jobs. People want ALC certificate be granted to DPs of 1971 camp and non camp as per Govt. order No. 174-GD Dt. 08-07-1971. Proper compensation be granted against fences, ditches and mine area along the international border. Let out families of 1971 be granted cash payment/compensation in lieu of deficiency of allotted agricultural land table units of land in their favour as per prevailing market rates per kanal. These are families who have not got any relief its number is more than 500 require proper compensation. They should be allotted agricultural land under cabinet order No. 578-C of 1954 by its modification or in alternative cash compensation be paid and like wise residential plots be allotted. In a similar manner non camp displaced of 1971 wants occupancy right over the evacuee lands under Sec 3-A of Agrarian reforms Act 1976, increase in ex-gratia relief upto 5 lacs. More than 1400 families were not registered require registration. Adequate compensation for property, which was left behind by DPs during 1947, 1965, 1971 be provided. No exercise has been done so for it reflect inhuman approach of the Govt. DPs of 1965 and 1971 need to be compensate for deficiency of land. All categories of DPs should be treated at par in respect of allotment of land more measures are required like relaxation in government services be provided including admission in professional colleges in state and in other parts of the country. Monthly relief be provided and the government has opted to settle DPs of 1947 by providing 8 acres of Abi-agricultural land and 12 acres of Khushki land per unit of families irrespective of size as per Govt. Order No. 578-C of 1954 this scale be made applicable to 1947, 1965 and 1971 and for displaced families reservation in legislative assembly is also justified and amendment in the constitution be made. Rs. 22000 crore package is required for all refugee, separate department for redressing their problems be created in state and centre. Migration from Kashmir started in 1989 onward. PoK sponsored terrorism made it difficult for a common man to survive with dignity and honour. Life remained under threat of elimination at every spur of movement. 3 lakh people were compelled by the circumstances to leave their homes. Maximum took shelter in Jammu region and some migrated to Delhi and in other parts of the country. Spirit of Jammu region should be appreciated by all. They remanded sufferer due to discriminatory policy of the state and centre government. But national spirit remained high and they absorbed all migrants, refugees and even faced war and massacre in 1947 and war in 1962, 1965, 1971 and recently Kargil war. We solute the spirit and dedication shown by majority residing in Jammu and Kashmir and Jammu, especially for accommodating all type of refugees and migrants. Let nation should take a lesson that certain objects in life are more important than life. Many persons inspired by circumstances belongs to RSS, BJP, VHP, HRS, ABVP has laid down their lives with the hope that they may vanish but their motherland and country should remain united. We solute to soldiers who sacrificed their lives in this part of the country in defending unity of state with rest of the country and discharged their duty with extreme dedication. Knowingly well that they are not even entitled to purchase an inch of land in this part of the country. Many individual including refugees reflected their patriotic spirit irrespective of caste, creed and religion. Muslim of Jammu region also remained sufferer but bonds of brotherhood are strong and can not be separated and segregated. Refugee problem was ignored due to Kashmir-centric approach of local leadership of local parties supported by Congress. Now, it is time when we should try to find permanent solution to the problem of refugees and migrants from Kashmir. Otherwise history will not forgive the present leadership of the time for their unsympathetic, casual, callous, inhumane, unconstitutional, unethical approach towards problems of refugees.
