J&K Assembly- 11 Private Members’ Bills moved in LA 4 deferred, 7 withdrawn

Srinagar, October 07 (Scoop News) – As many as 11 Private Members’ Bills were taken up in the Assembly for introduction and consideration. Of these, 7 Bills were withdrawn and 4 deferred for the next session.
The Bill to amend the Jammu and Kashmir Panchayati Raj Act-1989 Bill No. 21 of 2010, moved by M. Y. Tarigami, Bill to Amend the Jammu and Kashmir Land Acquisition Act Samvat 1990 Bill No. 15 of 2010 and Bill to Amend the Jammu and Kashmir Land Revenue Act Samvat 1996 Bill No. 16 of 2010 moved by Charanjeet Singh were withdrawn after thorough discussion.
The Government assured the Members that the amendments proposed will be considered at the time of comprehensive Bills to be moved by the Government during next session.
The Bill Nos. 8, 9 and 17 of 2010 with regard to provide punishment for torture inflicted by Public Servants or any person inflicting torture with the consent or acquiescence of any public servant and for matters connected there with or incidental thereto, moved by Ch. Mohamamd Ramzan, Er. Abdul Rashid and M. Y. Tarigami were also thoroughly debated. The Government opposed the Bills at the introductory stage and withdrawn by the Members.
While replying the debate on the Bills, Minister for Law and Parliamentary Affairs, Ali Mohammad Sagar informed the House that enactment of legislation on the subject is under consideration of the Centre and several States have been asked to give their opinion on the said legislation. The Minister assured that the piece of legislation will be considered after the enactment of legislation by the Centre.
Another Private Member’s Bill moved by Er. Abdul Rashid to make it obligatory for the Public men and Public Servants to educate their children in Government Educational Institutions and for matters connected therewith or incidental thereto (L.A. Private Member’s Bill No. 10 of 2010) was also withdrawn after threadbare discussion.
Replying to the debate, the Minster for School Education, Peerzada Mohammad Sayeed said that in the democratic setup, every citizen has a right to educate his children in any educational institution including private institutions. He said as a matter of fact, the private institutions have played pivotal role in providing quality education to the children and have brought a sea change in the educational set up. This has increased the literacy rate considerably in the State.
The Minister said that Government can’t force any person to educate his children through Government institutions only which is otherwise not justified.
Question Hour
39 gazetted, 506 paramedic posts filled up in Kargil -Minister for Health, Sham Lal Sharma has said that 157 gazetted, 632 paramedics and 384 Class IV posts were sanctioned for Kargil district. Of these 39 gazetted, 506 paramedics and 182 posts of Class IV have been filled up and the rest of them have been referred to concerned recruiting agencies.
The Minister was replying to a question by Aga Sayed Razvi in the Legislative Council today.
He said that the sanctioned strength of posts including the recent created 27 gazetted, 42 non-gazetted and 04 Class IV posts are being referred to the concerned recruiting agencies. He said that in addition to the two regular dental surgeons in position, seven have been engaged on adhoc basis and posted in Kargil. He said that the doctors would be posted at Sakar, Chiktan and Sankoo health institutions.
Inland Water Transport project not viable: Nasir
Minister of State for PHE, Urban Development, Nasir Aslam Wani has said that Inland Water Transport project on Jhelum from Parimpora to Pampore was entrusted to Srinagar Development Authority in 1997.
Replying to a question by Sheikh Ghulam Qadir Paredesi in the Legislative Council today, the Minister said that the project could not take-off as RITES team advised that silt deposition in the water channel would hinder its smooth running even if channel is dredged and was also felt that the project was not economically viable for SDA.
Nasir said that the Irrigation and Flood Control department has reframed the project in 2008-09 at an estimated cost of Rs.326.23 crores. However, no funds are available at present for execution of the project. He further said the government has already acquired a special boat for said purpose, but due to turmoil the work on the project has not been started yet. He said that work will be started very soon because environmentally it is very suitable.
32 eligible masters, teacher placed I/C lecturers in Botany: Peerzada
As many as 32 eligible PG masters and teachers have been promoted and placed as I/C lecturers in Botany in 2007 vide G.O. NO. 413- Edu-of -2007 dated 08.10.2007.
This was stated by Minister for Education, Peerzada Mohammad Sayeed in reply to a question by Haji Ali Mohammad Bhat in Legislative Council today.
The Minister said that status of vacancies in Botany and other subjects have also been worked out and filling process of these vacancies by direct recruitment and promotion as per prescribed recruitment rules is on. He said the preliminary exercise for making promotion has been completed.
Peerzada further said that botany is being taught in almost all existing Higher Secondary Schools and the posts have been created in newly upgraded Higher Secondary Schools, which includes Botany subject also. He said the process of filling up of vacancies by direct recruitment and promotion quota is in the final stage.
78 km stretch of Mughal Road made fair weather: Sagar
Minister for Rural Development Ali Mohammad Sagar today informed the Legislative Council that the fair weather single lane of the Mughal Road is 84 kms long, adding that its, 78 kms fair whether double lane stretch has been completed.
He said the roads double lane with GSB is 43.60 kms and WBM (DL) two layer is 40.20 kms. He said that its BM (50 mm thick) is 28.60 kms. He said that 213 culverts out of 424 have been completed and construction work for 7 major bridges has been already allotted.
The Minister was replying to a question by Mohammad Rashid Qureshi on behalf of Minister for PWD(R&B) in Legislative Council today.
Sagar said that government has proposed to allow limited/ controlled traffic on the road in October, 2010, however, the full traffic would be permitted after the road is black topped and completed in all respects.
The Minster said that the total expenditure incurred till date is Rs.368.03 crores as against revised cost of Rs.639.85 crore. He said that the current year’s approved allocation for the project is Rs.256.97 crore and added that 28 kms, out of 84 kms have already been macadamized. The entire road is expected to be macadamized by September 2011, he said.
Sagar said that the project was scheduled to be completed in 2012-13,however, due to intervention /stay of Supreme Court in a case related to wild life sanctuary (Hirpora to Pir-ki-Gali) from March 2006 to 2007 and some disturbances, caused to the delay in the work.
The Minister said that Government has assigned top priority to Mughal Road and no effort is being spared for completing this prestigious project within the stipulated time frame. He said by opening of Mughal road Mughal heritage will become available to be offered for “Carvan Tourism”. He said the department is exploring the possibility of developing these areas for tourist interest and is considering to get a comprehensive project report. He said after completing this road, Government would focus on other sports for promoting town.
33 sodium lights to be installed in Pahalgam, Ashmuj, Seer Hamdan: Aslam wani
Minister of State for PHE, Nasir Aslam Wani has said that the directorate of local bodies has authorized Municipal committees of Pahalgam, Ashmuqam and Seer Hamdan for installation of 33 sodium vapour lights costing RS.4 lacs.
The Minister was replying to a question by Altaf Ahmad Wani in the Legislative Council today.
He said that there is no detailed project report for providing street lights to these areas, adding that the installations of 14 numbers of sodium vapour lights have been completed at Ashmuqam while the process in Pahalgam and Seer Municipal Committees is under progress. He said that the villages of Batakot,Salar and Serigofwara do not fall within the municipal limits. He informed the House that no sooner the DTR will be ready ,I will submit it in the House.
3 road projects widened in Shopian: Javed
Minister of State for PWD (R&B), Javid Ahmed Dar today informed the House that three road projects viz Wasohalm-Hajiora road (6 kms), Kiloora-Malikgund road (2kms) and Nagbal-Turkwagan road (4 kms) have been upgraded and widened from 12 to 18 feet during the period 2008-10.
Replying to a question raised by Showkat Hussain Ganie in the Legislative Council today, The Minister said that the widening Shopian-Bijbehara road could not be taken up due to non availability of funds.

Land for bus stand in Poonch identified: Nasir
The Minister of State for PHE, Nasir Aslam Wani today informed the House that a piece of land has been identified near Sher-e-Kashmir bridge for construction of bus stand at Poonch. However, the funds are not available yet.
This was stated by the Minister in reply to a question by Jahangir Hussain Mir in Legislative Council today.
The Minister said that no funds yet have been earmarked for its construction. However, He assured the house that after getting report for Chief Architect who has been asked to estimate the cost report of the construction of bus stand at the identified land,the funds would allotted accordingly.
The Government of India has constituted National AIDS Control Organization (NACO) for controlling the epidemic of AIDS.
This was stated by the Minister of Health, Sham Lal Sharma in reply to a question by Ajay Kumar Sadhotra in Legislative Council today.
The Minister said that Dr. M. A Wani is Project Director of JKSACS ,who is also at present functioning as Director Health Services ,Kashmir.
Sharma assured the House that before Darbar Move, there will be a full flagged separate Director of AIDS control department.
