JKRCEA demands extension of Article 16 (4) A & B to the State for restoration of reservation in promotion
threatens mass agitation

Jammu, February 12 (Scoop News)- Demanding the extension of Article 16 (4) A & B of constitution of India to J&K State by Presidential Ordinance for the restoration of reservation in promotion for the employees of Scheduled Castes, Scheduled Tribes, Other Backward Classes and other categories, the heads of socio-religious, retired employees, youth & women wings of Jammu Kashmir Reserved Categories Empowerment Alliance (JKRCEA), a frontal organization working for the constitutional rights of reserved categories of State, in a jam-packed Press Conference held here today at Press Club Jammu have threatened of mass agitation if the reservation in promotion is not restored within next 15 days. The leaders who said that their communities in J&K are 50-60 lakhs, at the outset have condemned the state government’s luke warm response in defending their position on the issue of RESERVATION IN PROMOTION in scores of writ petitions’ in the high court of J&K. They also said that more frustrating for reserved categories were when the state bureaucracy acting as dictators deliberately ignored STAY ORDER of Supreme court in Naseeb Singh Vs State & Ors. Further it was told that the govt. is continuously ignoring our own High Court’s interpretations of Supreme Court STAY ORDER pronounced in writ petition SWP No. 924/2018 dated 01-05-2018 which speaks, “Meanwhile, respondents shall consider the claims of the petitioner for promotions against the post of Executive Engineer under reserved category by ignoring the impugned circular as the judgment passed by this court in reservation matter has been stayed by the Hon’ble Supreme Court.”



Taking into consideration all the aspects, the leaders disclosed that they called on the Hon’ble Governor of J&K to intervene into this very sensitive & serious matter and bring suitable ordinance/resolution/bill/amendment in the current session of the assembly to negate the effects of Division Bench Order of the High court. It is also stressed upon the government to adopt Constitutional 77th, 81st & 85th Amendments so that Article 16 4(A) & 16 (4) B is extended to J&K through Presidential Ordinance. But they expressed their concern that so far no action has been taken by the Govt. of J&K in this regard.



Bodh Raj Bhagat, Sr. Vice President All India Bhagat Mahasabha while speaking on the occasion warned that people may take drastic steps if callous attitude of government continue in the matter. He appealed for large scale social unity amongst SC, ST, OBC’s for a bigger fight. He warned the micro minority of this country that comprises of only less than 10% to desist from issuing irrelevant statements and added that before issuing such irrelevant statements they must assess their power and should not provoke majority community of this country.

Sham Lal Bassan, President Dalit Chetan Manch lambasted upon the failure of previous as well as present government to adopt the 77th, 81st & 85th Amendments of Indian Constitution. He further added that to get restoration of reservation in promotions reserved categories can go up to any extent as Reservation of any kind is constitutional right of these communities. He further warned the government that if government fails to come up with viable & just solution of the issues, they may take drastic steps of blocking National Highways, Rail & Air service from and to Jammu. He further said that few bureaucrats are illegally promoting employees ignoring Supreme court Order, these babus need to be carved adequately to avoid any crisis/unrest amongst the masses.

Prof Kali Dass representing All India Backward Classes Union advised the government to act quickly on otherwise sensitive issue before the reserved category people constituting about 60% population become unrest and take some drastic steps that shall not be in the larger interest of the government of the day. He also demanded that Enforcement Board meeting on monitoring & implementation of reservation as per Reservation act should be convened immediately calling intellectuals from civil society to come out with exact data how much reservation has been implemented and what are the areas that require further attention of the government.



Prof. G.L.Thappa, said that by not contesting in favour of their own law which is in consonance with Article 370, 35-A of Indian Constitution & Article 23 of J&K Constitution, the present government has shown its total immaturity in legally dealing with the issues of public importance. He advised the government to immediately extend Article 16 (4) A & B of constitution of India to J&K State by Presidential Ordinance to regain the confidence of Reserved categories.

Sunita Bangotra, Chairperson, Savitri Bhai Phule Mahila Sangathan said that for more than two years, JKRCEA members have been running from pillar to post requesting the bureaucrats, the then MLAs, ministers, Chief minister and now the Hon’ble Governor for an early resolution of the issue of reservation in promotion but very unfortunately despite the complete stay granted by Supreme Court on J&K High Court order by which the provisions of reservation in promotion were struck down, no authority has paid any heed to the plight of these marginalized section. She appealed the Hon’ble Governor personally intervene into the matter.

Nighat Shafeeq said that the leaders of political parties should not take the reserved categories for granted and practice of using them as vote bank now-a-days would not work for them. All those leaders may be were in power or not, who have not come to the rescue of these communities have lost their moral ground of asking the people of reserved categories to vote for such leaders in the forthcoming Lok Sabha and Assembly elections.

It was unanimously decided that if government fails to address the genuine issue of Reservation in promotion and if the vacant posts of Lecturers in 10+2 are not filled up from amongst those who appeared in the interview recently, a Massive agitation would be launched in across the state.

Pawan Bhagat, T.C.Bavoria, R.L.Dogra, Bhadur Lal, Romesh Kumar, R.L.Bangotra, Lok Nath, Dr.Hardyal, Avinash Kajotra (Youth leader, Kathua), Ram Rattan Drai (President Mahasha Sabha Udhampur), Vijay Bansal (President Guru Ravi Dass Sabha Udhampur), Somali (Sarpanch Sehora A), Vimla Devi, Chanchal Devi (Panch), Girdhari Lal Rahi, Master Baldev Raj, Bihari Lal Bhagat, Puran Atri, Tara Chand Samyal and Sunita Kumari.
