DB provides final chance to Div Com to submit status report on encroachment of migrant properties, allows six weeks time



Jammu, December 10, (Scoop News)-The Division Bench comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar has accorded a final chance to the Divisional Commissioner Kashmir for submitting status report on encroachment of migrant properties.
“The status report shall clearly state as to whether the work of identification of the encroachment of the properties of the migrants in Kashmir division has been undertaken by the respondents,” they observed after hearing the submissions of senior Advocate PN Raina with JA Hamal.



The Division Bench further pronounced, “The status report shall also indicate the steps taken by the respondents under section 4 of the Jammu and Kashmir Migrant Immovable Property (Preservation, Protection and Restrain on Distress Sales) Act, 1997, for maintenance of the properties in Kashmir division after obtaining possession thereof within six weeks from today.”



All India Kashmiri Samaj, a social organization representing displaced Kashmiri Pandits, had filed a petition in this regard in the Apex Court. Thousand of Kashmiri Pandit families had to leave their homes and hearths, worth billions of rupees, in haste after armed insurgency broke out in Kashmir in 1990.
