Rash and negligent driver convicted for 1 year jail term after 8 years trial

Srinagar, June 29, (Scoop News)-Court of Additional Special Mobile Magistrate Awantipora with Miss Fozia Paul in chair, after hearing Khursheed Ahmad Sr. Prosecuting Officer for the state and counsel for the accused , convicted a person namely Ghulam Mohi-ud-din Bhat son of Abdul Ahad Bhat resident of Renizipora Awantipora for causing death of a pedestrian girl namely Yaseena Akhter daughter of Mohammad Ramzan of Reshipora Awantipora and injuries to another girl namely Mubeena daughter of Mohammad Yousuf Dass of Reshipora by rash and negligent driving of a TATA SUMO bearing registration No. JK13-9319.

The convict had hit the said girls while driving the said vehicle on 08-12-2007 at Beigpora Awantipora. He has been sentenced to undergo imprisonment for a period of one year for the commission of offense punishable U/S 304-A/RPC. Fine of Rs. 5000/= has also been imposed on convict for the commission of said offence. He has also been ordered to undergo imprisonment of four months for the commission of offence punishable U/S 337/RPC and two months for the commission of offence punishable U/S 279/RPC.


The trial court turned down the plea of convict for release on probation in terms of section 562/ CrPC when Mr. Khursheed Ahmad Sr. Prosecuting officer who represented the state in the case vehemently resisted the same. While referring various judgements of Supreme Court of India the court observed that “bearing in mind the galloping trend in road accidents and the devastating consequences visiting the victims and their families, criminal courts can not treat the nature of offence U/S 304-A/RPC as attracting the benevolent provisions of the Probation of offenders Act”. Later the convict was lodged in Central Jail Srinagar in pursuance of orders of trial court to serve the sentence.
