Around 8 lakh persons in our state posses minor to severe disabilities and need rehabilitation through various ways. We the persons with disabilities of J&K state face immense challenges. We have faith that the coming Budget will include persons with disabilities in following:
3% Budget Allocation for the rehabilitation and inclusion of persons with disabilities so that all state infrastructure and under construction buildings like Court Complexes, hospitals, college Buildings, Mini secretariats in new districts, polytechnic colleges, University Buildings, Shrines, Parks, places of recreation, Gardens, TRC terminals, Library buildings and many other buildings could be made barrier free by provision of Ramps lifts, signage’s, Braille scripts and tactile paths, as mandated by the Honorable supreme Court orders, UN convention on the Rights of Persons with Disabilities Ratified by our Country since October 2007 and Disability legislations in india.
From 12th five year plan then planning commission, now Nitti Aayog has directed that 3% budget benefits will provide access to work and employment for persons with disabilities. Therefore special drive for the recruitment of persons with disabilities may please organized to provide employment to highly qualified persons with disabilities, who are now at the verge of overage and have either old aged parents or lost the parental support. Many persons with disabilities hold contract cards. All the contractors with disabilities should get 3% work order benefits / contracts in all departments.
In other states of the country like In Delhi, Uttar Pradesh and even Tilangana state which was recently established the integrated social security scheme stipend is rupees 1500/- at least. But our state still gives it very meager four hundred in which centre share is 300/- rupees and state share is 100 rupees only. The severe disable persons like spinal cord injured persons, mentally disable persons, landmine survivors, conflict victims, severe cerebral palsy affected, autism affected, Hemophilia affected, Severe Muscular Dystrophy affected and multiple disable persons have high medical and support / care/ nursing needs. Thus 80% above disable persons should get at least 5000/- rupees as monthly social security grant and other disable persons should get 2000/- as monthly grant under ISSS scheme. All the persons with disabilities getting job should get NOC from social welfare department and at the time of appointment their ISSS grant should be stopped and should cover the pending beneficiary.
The Employees with disabilities should get conveyance allowance at par with central Government employees at least 3000/- the general transport is not accessible and persons with disabilities need special arrangements. In addition all new purchase of buses should be low floor with access to wheel chairs. It is possible with your personal intervention through a strong circular.
The recruiting agencies are giving troubles to persons with disabilities. The problem is persons with disabilities are asked to compete with open merit candidates in screening test but the problem is for persons with disabilities no schools have proper access, no accessible teaching learning material is available, no special educators are available. Disable students have to complete answering questions in exams at par with non disable students within prescribed time limit. Disable students have to reach exam centers in all odd climatic conditions. No common transport accommodates wheel chair users and other severe disable students. Thus special transport is needed. Exam time is mostly in winter blind, wheel chair users, crutch dependent have to take escort or helpers to reach exam centers. Thus real deserving disable persons overcome all such odds but there is less marks percentage. There performance will be to some extent less. Please give Vertical 3% reservation in the employment so that after heavy struggle in life, economic empowerment is sought by the educated persons with disabilities. We have well qualified candidates with disabilities in our state that got dropped because of lot of barriers created by recruiting agencies for past 10 years. The JK Disability Act – 1998, Job identification for persons with disabilities under government order 147SW of 2014 and other disability rules are being violated by all the Recruiting agencies. The recruiting agencies may please be made accountable regarding the reservation served to educated persons with disabilities. The backlog posts need to be filled as per the orders of Honorable Supreme Court Ruling.
In all other states the there is reservation in all professional courses for the eligible persons with disabilities. But our state is the only state in the country where there is no reservation in professional courses. We are not mentioned in notification of the Board of Professional entrance examinations. It is complete injustice and discrimination as per the mandate of J&K persons with disabilities Act – 1998 and rules thereof. Educated but eligible Persons with disabilities should get the reservation in professional courses. Otherwise we the disable persons are under estimated and social stigmatized.
Hope the underprivileged section of society will be Listened Well and inclusive approach will be used to frame the Budget.
